1. Introduction
Welcome to Synatec LLC’s hosting services. These Terms of Service govern your use of our hosting services. By using our services, you agree to comply with these terms.


2. Non-Allowed Uses
You may not use our hosting services for:
· Listing IPs on Spamhaus: Any activities that could lead to our IP addresses being blacklisted by Spamhaus or similar organizations.
· CSAM Content: Hosting, storing, distributing, or linking to Child Sexual Abuse Material (CSAM) or any illegal content.
· Outbound Mail Spam: Any kind of spam emails sent through our network will not be tolerated, port 25 is blocked in order to fight spam.
· Outbound DDoS Attacks: Initiating or participating in outbound Distributed Denial of Service (DDoS) attacks from our infrastructure.


3. Usage Restrictions
You may not engage in activities that harm our network, servers, or other users.
In order to fight mail spammers and such, port 25 is fully blocked on all of our products. If you wish to have the port unblocked, contact us via live-chat with valid justification.


4. Service Level Agreement (SLA)
Our Virtual Private Server (VPS) products come with a Service Level Agreement (SLA) of 99.99%. Any downtime exceeding 1 hour, provided it is caused by us or due to force majeure events, will be compensated.
Our Dedicated Servers have an SLA of 100%. Any downtime caused by us or due to force majeure events will be compensated.


Compensation Calculation:
The compensation for downtime will be calculated using the following formula:
(Server Price / 30 days / 24 hours) * hours of downtime} = Total compensation in EUR


Exclusions:
Please note that compensation applies only to downtime caused by us or force majeure events. Downtime resulting from scheduled maintenance, customer actions, or third-party issues are excluded from this SLA compensation.


Depending on the customer's preference, the downtime can be compensated either via Credit or by extending the subscription of the affected server.


5. Consequences of Violation
Violating these terms may result in suspension or termination of your account without notice.


6. Subscriptions
The subscriptions of Dedicated Servers will start once the server is activated, installed, and reachable from the internet.
The subscriptions and invoices are on a 30-day basis, they can be prolonged directly through our Control Panel.


In the event of a missed payment, the data on the servers will be retained for a maximum period of 3 (three) days.
If the payment is still missing after 3 (three) days, the data will be erased permanently from our systems and will render your service irrecoverable.
In the event of a missed payment, the server will receive an additional charge for the reactivation of 10% of the server monthly billing.


We reserve the right to terminate your subscription at our sole discretion, for any reason, without prior written notice.


7. Fair-use Policy
Under the terms of our Fair Use Policy, you are permitted to utilize the ports on our VPS servers without restriction on the rate of usage. However, it is expressly prohibited to engage in activities that result in high throughput on any port. If the port is utilised heavily it will be limited or blocked.


8. Disclaimer of Liability
We are not liable for any damages arising from your use of our services. You are responsible for maintaining backups of your data.


9. Modifications to Terms
We may update these Terms of Service from time to time. We will notify you of significant changes. Continued use of our services after changes constitutes acceptance of the updated terms.
